Four former delivery drivers for Amazon Prime Now, or APN, last week filed a lawsuit against Amazon, arguing they should have been classified as employees rather than independent contractors. The suit also names Scoobeez, the courier service through which they worked for Amazon; ABT Holdings, Scoobeez’s parent company; and 10 John Does as co-defendants. Attorneys from Leonard Carder filed the suit in California Superior Court in Los Angeles County. They are seeking class-action status.
This is a similar suit that was filed by some FedEx delivery people. They also claim their schedules, uniform requirements and other requirements made them employee's not contractors. It seems many companies now think they can avoid the negatives of employment by classifying everyone as contractors. Uber is another example of this and frankly its a disturbing trend and one that the courts so far have ruled in favor of contractors. Companies need to be aware that a contractor is a person who is self employed and in that is not subject to the same requirements for a job as a employee.
Amazon appears to want their cake and eat it too and it just does not work that way. Especially when from what I've read. The delivery contractor pay is very poor for these contractors too.
