The first rule of Apple's App Club is: You do not talk about App Club. Any developer who writes an app for the App Store is forbidden from making any public statements about the iPhone Developer Program Licensing Agreement. Second rule of App Club is: Said developers also can't sell their apps to other app stores, even if that app is eventually rejected by Apple.

Apple has announced the iPad will hit retail shelves April 3, sending the adrenalin surging through competitors' veins. HP and several Chinese manufacturers have announced tablets in what might be perceived as an attempt to capitalize on the not-quite-a-laptop, not-really-a-netbook category.

Many factors likely fueled Apple's lawsuit against mobile handset manufacturer HTC. Patent suits have become a competitive weapon -- one that any company dare not allow its rival to use without using it as well. Lawsuits are sometimes filed because a firm believes it's about to be slapped with one. There's a case to be made, of course, that HTC has, in fact, infringed.

The lawsuit Apple filed this week may target smartphone maker HTC, but Cupertino is likely shooting for much bigger prey. Specifically, Google is the real focus of Apple's wrath, said Chris Hazelton, research director for mobile and wireless with the 451 Group. The numerous issues listed on Apple's simultaneously filed complaint with the ITC are "all based on what the operating system does and how it interacts."

Apple's share prices have begun climbing back since Feb. 23, closing Tuesday at $208.85. It's not yet quite clear why -- it could be the imminent shipping of the iPod or the shareholders' meeting Feb. 25, among other things. Still, investors should take what they can get. They'll have to -- Cupertino isn't about to fork over any dividends soon.

Apple Sues HTC for Patent Thievery

Apple has filed a lawsuit against smartphone manufacturer HTC, alleging that the company has infringed on 20 patents related to the iPhone. The complaint cites Google's Nexus One, the T-Mobile G1, the Droid Eris, the Touch Diamond, the Touch Pro2, and the Imagio as examples of infringing devices. Apple also filed a complaint with the ITC seeking to block imports of these products.

You don't have to search very hard on Apple.com to find the 2010 Supplier Responsibility Report, the company's internal audit of how workers are treated on the assembly lines at the overseas third-party companies making its Macs, iPhones and iPods. I'm still not personally sold on the idea that I need an Apple iPad, but I very much like what I'm seeing in the publishing industry in response to the fledgling product. Conde Nast is a respected publisher that's looking to do something cool, new and proactive for its magazines -- create digital versions that push the boundaries of digital magazine delivery.

Was the iPad a Mistake?

This isn't to ask whether it will be successful. Apple is a master at setting goals and then exceeding them, and a lot of folks are clearly excited about the iPad -- but the first generation iPhone was kind of a mistake that got corrected in later versions. I'm increasingly thinking that Steve Jobs' initial concerns with this offering were well founded.

Apple stock closed at $197.05 Tuesday, down $3.37 after a five-day rally that saw it hit $203.08 Friday. However, that slide was part of an overall market phenomenon. On Tuesday, the Dow Jones Industrial Average shed 100 points and the NASDAQ composite index lost about 29 points as consumer confidence took a tumble.

The International Trade Commission has agreed to investigate both Apple's and Nokia's claims that each has infringed the other's patents. The ITC is also investigating a complaint filed by Motorola that Research In Motion has infringed on its patents. As is usually the case when the ITC is asked to step into a dispute, its decisions are expected to be swift, and the potential penalties severe.

I'm both irritated and pleased that Apple is waging a war on anything sexy in its iPhone, iPod touch, and soon-to-be-released iPad App Store. The company in Cupertino has been systematically removing thousands of apps that could be construed as sexy, have adult-oriented images, or just simply show chicks in bikinis -- wait, now that's a great idea for an app.

Is Google the Next Microsoft and Microsoft the Next Apple?

This past week, two rather interesting events got me thinking about how Apple, Google and Microsoft seem to be changing places. Microsoft announced Windows Phone Series 7, and Google announced Buzz (also known as "Buzz Kill") into the market. Microsoft kind of pulled an Apple with this, in that it stepped away from the field and created something distinctly different and potentially more capable.

Apple's role as the book publishing industry's white knight may be over even before it has begun. Cupertino may not be willing to allow publishers as much leeway in setting their own e-book prices as previously thought, according to a New York Times report. After unveiling the iPad Jan. 27, Apple shook the e-book world with its statement on e-book pricing.
