> They (SCO) actually have an impressive war chest > at this point and are profitable, both of which > suggest something is working. . SCO eeked out a 3 million dollar profit, not from sales of any of their products, but from the money they got from Sun and Microsoft. Their sales from their traditional Unix business declined from 16 million to 13 million in Q3. They have one single patent. . You consider that a "warchest"? . IBM makes in profit several billion per quarter, and has over 30,000 patents - of which I'm sure every Canopy company violates at least one. In David and Goliath fights, David usually loses. . > If I were them would I be going down this path? > Not on your life. You point out only some of the > risk and right now if they lose, you are > probably right, they are done. Even if I’m right > and this is 60/40 betting the company on those > kinds of odds would seem excessively risky. . What most of us are trying to figure out is why do you think you're right? You didn't show any supporting evidence. You ignored that SCO has already lost a similiar case in Germany. You neglected to mention that all the evidence they have shown publicly was completely debunked. You forget to mention that if indeed SCO is telling the truth and there are MILLIONS of lines of infringment that's 1/3rd of Linux, and just NOW SCO notices it? To trust SCO in this is naive to an extreme. . > And if it were Intel rather than IBM on the > other side I’d bet differently because Intel > uses litigation like an offensive weapon, IBM > has been too risk adverse for too long and I > blame their legal department for much of this > current problem. . What if SCO was trying to get Microsoft end users to pay $699 per CPU for an undisclosed infringement? What then? You seem to think Linux is something different - it's not. SCO isn't following traditional IP litigation routes. They have to mitigate or they lose all rights to the IP. It's rule #1 in IP litigation. . The Linux developers want to see this go to court. I'd hate to see SCO improperly profit from their extortion.
