Maybe, while I’m clearly not an attorney I did write a number of the contracts that IBM used in the same time frame as the AT&T license and we believed at that time language like this was enforceable, breaking this license will have some interesting implications for IBM and their own contracts and licenses. I believe the license will hold or that IBM will recognize the risk and not work to break any of the major sections. But we will clearly see. One thing is clear if they could get it killed, with the cancellation of AIX, they (IBM) would have done that by now to remove the cloud from that product. I have never seen an IBM product put under a cloud like this and it still looks to me like someone over there really messed up.
